TapToPark Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the TapToPark mobile application, website, and related services (collectively, the “Services”) provided by TapToPark LLC (“TapToPark,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. Eligibility

You must be at least 18 years old to use the Services.

By using TapToPark, you represent and warrant that you meet this requirement.

2. Description of Services

TapToPark provides a digital platform that enables users to:

Initiate, extend, and end parking sessions
Pay for parking through supported payment methods
Receive notifications related to parking activity
Interact with participating parking operators and facilities

TapToPark acts as a technology platform connecting users with independent parking operators and municipalities.

3. Account Registration

To access certain features, you must create an account and provide accurate, complete information.

You are responsible for:

Maintaining the confidentiality of your login credentials
All activity under your account
Ensuring your vehicle information is accurate

TapToPark is not responsible for penalties resulting from incorrect vehicle details.

4. Payments & Fees

Parking fees are set by the applicable parking operator or municipality.

By initiating a parking session, you authorize TapToPark and its payment processors to charge:

Applicable parking fee
Service fees (if applicable)
Taxes

All transactions are final unless otherwise required by law.

TapToPark does not guarantee refunds for expired sessions, enforcement actions, or operator-issued penalties:

5. Parking Enforcement & Liability

Users are responsible for complying with all posted parking rules, regulations, and time limits.

TapToPark:

Does not control parking enforcement decisions
Does not guarantee protection from citations or towing
Is not responsible for penalties issued by operators or municipalities.

Parking availability is not guaranteed.

6. License Plate Recognition (LPR)

At participating facilities, third-party LPR systems may capture license plate information.

You acknowledge that:

LPR systems may be used to validate parking sessions
Failure to maintain an active session may result in enforcement action
Technical errors may occur

TapToPark is not liable for enforcement decisions made by operators using LPR systems.

7. Prohibited Conduct

You agree not to :

Provide false or misleading information
Attempt to bypass payment requirements
Interfere with system security
Reverse engineer or exploit the Services
Use automated scripts or bots

We reserve the right to suspend or terminate accounts that violate these Terms.

8. Service Availability

We strive to maintain reliable Services but do not guarantee uninterrupted or error-free operation.

The Services may be affected by:

Network outages
System maintenance
Third-party provider disruptions
Technical failures

TapToPark is not liable for losses resulting from temporary outages.

9. Intellectual Property

All content, branding, logos, software, and technology associated with TapToPark are the exclusive property of TapToPark LLC.

You are granted a limited, non-transferable, non-exclusive license to use the Services for personal, lawful purposes.

You may not copy, modify, distribute, or create derivative works without written permission.

10. Third-Party Services

The Services may integrate with third-party systems including:

Payment processors
Parking management systems
License plate recognition providers

TapToPark is not responsible for the performance or policies of third-party services.

11. Disclaimer of Warranties

The Services are provided “as is” and “as available.”

To the maximum extent permitted by law, TapToPark disclaims all warranties, including:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability

TapToPark is not responsible for the performance or policies of third-party services.

12. Limitation of Liability

To the fullest extent permitted by law, TapToPark shall not be liable for:

Parking citation
Towing or vehicle damage
Lost profits or revenue
Indirect, incidental, or consequential damage

Our total liability shall not exceed the amount paid by you through the Services in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless TapToPark, its officers, employees, and affiliates from claims arising out of:

Your misuse of the Services
Violation of these Terms
Violation of applicable laws or parking regulations

14. Account Suspension & Termination

We may suspend or terminate your account if you:

Violate these Terms
Engage in fraudulent activity
Misuse the platform

You may terminate your account at any time by contacting support.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

Any disputes shall be resolved in the courts located in Florida.

16. Dispute Resolution; Binding Arbitration; Class Action Waive

A. Informal Resolution First

Before filing a claim, you agree to contact TapToPark at support@taptopark.com and attempt to resolve the dispute informally. The Parties agree to work in good faith to resolve any issue within thirty (30) days.

B. Binding Arbitration

If a dispute cannot be resolved informally, it shall be resolved exclusively through final and binding arbitration, rather than in court, except as otherwise required by law.

Arbitration shall be conducted on an individual basis by a neutral arbitrator in the State of Florida under applicable arbitration rules.

Judgment on the arbitration award may be entered in any court of competent jurisdiction.

c. Class Action Waiver

You agree that any dispute will be conducted solely on an individual basis. You waive any right to:

Participate in a class action lawsui
Participate in class-wide arbitration
Act as a plaintiff or class member in any representative proceeding No arbitrator shall have authority to consolidate claims or conduct class proceedings.

D. Exceptions

Either Party may bring claims in small claims court if eligible.

17. Changes to These Terms

We may update these Terms periodically. Updates will be posted within the app or on our website.

Continued use of the Services constitutes acceptance of the revised Terms.
